Data protection information and declaration of consent

The customer is hereby informed of the data protection information and he declares his declaration of consent to data protection.

The customer has or intends to conclude or intends to conclude a purchase contract with OXY 8 Naturkosmetik GmbH through a personal order or an online order. In order to prepare and/or fulfill the aforementioned agreement and for its own legitimate interest, OXY 8 Naturkosmetik GmbH is entitled to process and store customer data and pass it on to partner and logistics companies. OXY 8 Naturkosmetik GmbH, represented by the managing director Wolfgang Klimas , is responsible for data processing.

Legal basis and purpose of data processing

OXY 8 Naturkosmetik GmbH processes all of the customer’s personal data, including personal and account information (if provided), on the basis of this declaration of consent and the statutory provisions of the General Data Protection Regulation (GDPR), the German Commercial Code (HGB), the law on tracking down profits from heavy Criminal offenses (GWG) and the Federal Data Protection Act (BDSG). The processing of personal data takes place on the basis of Article 6 Paragraph 1 lit. a/b GDPR. The data is stored and processed for the purpose of preparing and/or fulfilling the contract with the customer.
In addition, personal data is processed and stored to fulfill legal obligations such as commercial, tax and supervisory obligations and to fulfill the advisory obligations of OXY 8 Naturkosmetik GmbH. The legal basis is Art. 6 paragraph 1 lit. F GDPR.
According to the above, the customer expressly agrees to the collection, storage, processing and disclosure of his personal data, in particular account information, by OXY 8 Naturkosmetik GmbH and the partner companies cooperating with this company for the purpose of fulfilling the contract. This consent applies regardless of the existence of a contract as well as for future care services of OXY 8 Naturkosmetik GmbH.

Authorizations and recipients of the personal data

The customer agrees that the employees, commercial agents, authorized dealers and other vicarious agents contractually associated with OXY 8 Naturkosmetik GmbH, in compliance with the statutory provisions on data protection, collect, store and view the customer's personal data, in particular financial data, and for the purpose of fulfilment of the contract with the customer.

The customer agrees that his personal data, including financial data, may be passed on to existing or future contractual partners of OXY 8 Naturkosmetik GmbH, insofar as this is necessary for the fulfillment of the contract. Contract partners of OXY 8 Naturkosmetik GmbH are entitled to collect the customer's personal data and to process and store it when executing contracts. As part of its work, OXY 8 Naturkosmetik GmbH may pass on customer data for the legal examination of claims and for obtaining expert opinions to persons who are professionally bound to secrecy.

OXY 8 Naturkosmetik GmbH works with various cooperation partners as part of its activities. The authorized cooperation partners receive the customer's stored data as part of the fulfillment of the contractual obligations of OXY 8 Naturkosmetik GmbH. You collect, use and store this within the framework of the granted declaration of consent under data protection law.

Duration of data storage

The customer's personal data will be deleted as soon as they are no longer required for the fulfillment of the above-mentioned purposes and legitimate interests of OXY 8 Naturkosmetik GmbH. Insofar as data is required to fulfill tax, commercial or contractual obligations, in particular with regard to claims for damages, the data will only be deleted after the time at which the respective claims have expired. The customer expressly agrees that backups secured by the deletion claim are not covered and that his data is stored securely in this respect. Under the conditions of the GDPR, the customer has the right to correction, deletion, restriction of processing and the right to the surrender of the data provided by him. In addition, the customer has the right to data portability.

Customer's right to complain

The customer has the right to contact OXY 8 Naturkosmetik GmbH or the data protection authorities or the respective state office for data protection supervision with complaints.

Declaration of consent to the legal successor and OXY 8 Naturkosmetik GmbH

The customer agrees that all data collected, processed and stored by OXY 8 Naturkosmetik GmbH on the basis of this declaration of consent, in particular financial data and contract data, may be transferred to a legal successor and/or purchaser of the contract portfolio of OXY 8 Naturkosmetik GmbH. The aforementioned transfer of data takes place with the purpose that this recipient can also fulfill his contractual and legal obligations. The customer agrees that OXY 8 Naturkosmetik GmbH may be represented by third parties if this is necessary to fulfill the contractual obligations.

The customer can revoke the declaration of consent to the use, storage and transfer of his data at any time and without giving reasons. In this case, OXY 8 Naturkosmetik GmbH will immediately inform the contractual partners and cooperation partners concerned about the revocation. He will act in accordance with the provisions of the GDPR and the BDSG. A revocation must be declared to the person responsible.
